Brewster Kahle's successful resistance of an FBI order for the release of one patron's records, via one of those secret National Security Letters authorized by the Patriot Act, hinged upon the idea that the Internet Archive is, as all libraries are, exempt from requests of that type.

What I'm curious about is how EFF convinced the court that an entirely digital archive constitutes a library. One imagines the "where the books?" question may have come up.
